Q. Ex-Husband fighting a Child Custody with ex-wife

Salam brothers and sisters,

I was divorced for about 2 years back and i got the custody of my son age 5. I have a daughter age 6 and custody is to my ex husband. Reason being for this arrangement is due to thinking that my ex husband will be able to buy a house for himself where he can stay wif his family and where the kids can spend time with him during holidays and weekends. I allowed for his mother to care for both my kids because i dont wan to seperate the siblings and let them spend as much time together and so they're able to go to the same school and see each other every day. This is the sacrifice i made in order not to affect the kids due to our divorce. However as time goes by, my daughter is beginning to listen to her grandfather's influence and she begin to be scared to go out with me fearing that the grandfather will reprimand her. Therefore, it has been difficult for me to even bring her anywhere even though i go there every week. Recently, there has been some misunderstanding between me and ex husband and he threatens to wanting to fight for my son's custody. I would like to ask if its still possible for me to fight for my daughter's custody and for my son, i would like to take him away and let him just stay with me and fight for the sister's custody following that.

Salam to you,

there's a lot of things which need to be consider.
- are you a housewife
- if no you,Is you salary sufficient to maintain the children?
- maintenance fee base on court decree? did he owe you or outstanding in terms of monetary ? etc mutaah or eddah?

The reason why I ask you this is because Court will consider this base on capability and financial capacity. I you own a flat, should not be any problem.
