Q. Marriage Cert - 4 mths w/o husband's presence is divorced?

I'm married last year on April and i got pregnant in August. On December something happened and he left me untill now he's not back. I've already gave birth to a baby girl on May and he got to know and called me by my house phone just to make me angry but he never come back to meet his kid.
Knew that i was being cheated.

I told him that im want to get a divorce. But come to think of it when we got married the marriage cert stated very clearly that if husband left the wife for more than 4 months then it automatically consider talak. Is it true? im cnfuse abt this. Now for my case its already more than 8 months. He knew that i was pregnant and never give me any maintainance at all.

sorry to hear of this. it's better for you to go to Syariah Court. Eventually you'd have to do so anyway. They'll advise you accordingly. If it does mean automatically divorce/talak, you'd still need to have it formalised, have it on paper evidence. Then you could fight for yours and your daughter's rights and claim maintenance.

Yes,Hidayat is right.
I'm sorry to her about your situation but I think you should go to the syariah court and get things sorted out. You need to move on especially now you have a daughter to think of.
