Q. Is this seperation legal?

Dear All,

I would like to find out, there's this couple, the wife is a singaporean and the husband is a foreigner, they married at the husband's country, but the wife never registered their marriage in Singapore. Now that they have 'separated', not legally, does this mean that the wife is free to marry again since in singapore there is no record of marriage at all?

For your info, the guy is abusive & like a psycho.... he refuses to divorce her and she is constantly in fear....

if she can marry in singapore, how do i go about helping her...?

Please help....

Salam,

I think you have to go to the Syariah Court to get advice.

Since the separation is not legal, the Court will advise your friend what steps she can take to make it legal.
Until then, I think she is not free to marry again until her status is clear. It is not only a question of record but also her marital status.

Your friend should also make a police report about the abuse, so that the Syariah Court will have evidence to allow her divorce petition.

You can also get advice from PPIS or Family Service Centre.

ok basically if the couple didnt apply at ROM. The civil marriage is still considered valid in the singapore law provided they r both non muslims.

If one of them is muslim and did the civil marriage thingy, its invalid in singapore law.

Thats the problem we are talking about!!!!

muslims CANNOT go through civil marriages. Got to pay high prize when things go wrong.

My recommendation is that you consult a ustad with the real details and he will be able to help. I have witnessed a simlar case, where the ustad officially drops the talaq on behlaf of the husband due to the circumstances and the women being able to re-marry and start afresh.
